The Canada Agricultural Review Tribunal was established under the Canada Agricultural Products Act (CAP) and continued under the Agriculture and Agri-Food Administrative Monetary Penalties Act (AMP). The AMP Act assented to on December 5, 1995, establishes, as an alternative to the existing penal system and as a supplement to existing enforcement measures, a fair and efficient administrative monetary penalty system for the enforcement of the Agri-Food Acts, namely, the Health of Animals Act, Plant Protection Act, Pest Control Products Act and a few more. Pursuant to the CAP Act, the Review Tribunal has been given the power to hear two (2) types of reviews: Reviews of Board of Arbitration decisions; Reviews of various Agencies' notices of violations. La Commission de révision a été constituée en vertu de la Loi sur les produits agricoles au Canada (PAC) et prorogée en vertu de la Loi sur les sanctions administratives pécuniaires en matière d'agriculture et d'agroalimentaire (SAP). La loi SAP établit un régime juste et efficace de sanctions administratives pécuniaires comme solution de rechange au régime pénal et comme complément aux autres mesures d'application des lois agroalimentaires déjà en vigueur, notamment la Loi sur la santé des animaux, la Loi sur la protection des végétaux et la Loi sur les produits antiparasitaires. En vertu de la Loi PAC, la Commission de révision est habilitée à entendre deux types de demandes de révision : d'une part, les demandes de révision des décisions du Conseil d'arbitrage, et d'autre part, les demandes de révision d'avis d'infractions d'agences.
