CONT

A licence is a permission given by the occupier of land which allows the licensee to do some act which would otherwise be a trespass, "e.g.", to lodge in his house. (Megarry and Wade, p. 776)

CONT

A licence is in the nature of a right or privilege to enter upon and use the grantor's land in a certain manner or for a specified purpose. It is a personal right between the licensor and licensee and does not create any estate or interest in the land. (Anger and Honsberger, 2nd ed., p. 918).

CONT

A licence differs in its essentials from an assignment. A licence, even though exclusive, does not give the licensee all the rights of the patentee. A licence does not set up rights as between the licensee and the public, but only permits him to do acts that he would otherwise be prohibited from doing. He obtains merely a right of user. ... A licence prevents that from being unlawful which, but for the licence, would be unlawful; it is a consent by an owner of a right that another person should commit an act which, but for that licence, would be an infringement of the right of the person who gives the licence.

OBS

The spelling licence, though still often met with, has no justification in the case of the substantive. In the case of the verb, on the other hand, although the spelling licence is etymologically unobjectionable, license is supported by the analogy of the rule universally adopted in the similar pairs of related words, practice sb., practise vb, prophecy sb., prophecy vb. ... Recent dictionaries, however, almost universally have license both for substantive and verb, either without alternative or in the first place.

CONT

Pour bien comprendre en quoi consiste le contrat de licence, il importe d'abord de mettre en lumière ce que concède le breveté et ce qu'obtient le licencié. [...] Du côté du breveté, il y a simple concession de la jouissance du droit d'exploiter; mais ce droit lui-même reste aux mains du breveté, qui n'a pas entendu en disposer. [...] Du côté du licencié, il est certain que celui-ci obtient la jouissance du droit d'exploiter le brevet.

DEF

A right or permission granted in accordance with law by a competent authority to engage in some business or occupation, to do some act, or to engage in some transaction which but for such license would be unlawful ...

OBS

The term "licence" is not invariably translated by the French "licence" although it is in most cases. The reason is that in English the term does not necessarily imply a business or occupation as does the French: "driver's licence" and "marriage licence" are examples of this. One must therefore be careful in translating "licence"--its usual French equivalent is "licence", but in some cases it can be "permis". An important characteristic distinguishing "licence" from "permit" is the fact that the former is not issued directly by the government but rather by a competent authority or by local authorities, while any of the three groups mentioned can issue a permit. Also, the licence is usually granted for an extended period of time whereas the permit normally authorizes an act of short duration. For example, we say "driver's licence", but "learner's permit".

OBS

In Canada the British spelling (licence) is used more often than the American spelling (license), although both are found in Canadian texts.

OBS

"Licence" is one of two words that in Canadian English are usually spelled differently as nouns and verbs. The preferred spelling for the noun is "licence" and for the verb "license" ... The spellings of the other word are "practice" and "practise".

OBS
