Chartrand Co. Ct. J. found that while the loss of profit was foreseeable, it was too remote. However, he held that the wages could be recovered as they represented "positive outlays" which constituted "a proximate and direct consequence of the wrongful act of the defendants and (were) not too remote to be recovered", rather than "negative" ones, consisting of a "mere deprivation of an opportunity to earn an income"

Le juge Chartrand, de la cour de comté, statua que, si la perte de profits était prévisible, elle était cependant trop éloignée. Il jugea cependant que les salaires donnaient droit à réparation en ce qu'ils constituaient des frais «réellement engagés» représentant «une conséquence immédiate et directe de l'acte fautif de la défenderesse et (n'étaient) pas trop éloignés pour ouvrir droit à réparation», plutôt qu'un simple manque à gagner, c'est-à-dire la «simple perte d'une occasion de réaliser un profit».
