Une infraction successive ou infraction de succession, est une infraction dont le fait matériel n'est définitivement consommée qu'au jour où les conséquences de l'acte cessent de se produire. Selon, la jurisprudence, une infraction est successive lorsqu'elle se renouvelle par une réitération de la volonté de son auteur. (le délit d'ouverture illégale d'un délit de boisson dure jusqu'à ce que le débit de boisson soit fermé).
