Selon le Juridictionnaire, il conviendrait de mettre de l'ordre dans la terminologie du Code criminel. On pourrait résumer comme suit le nouvel usage proposé au sujet des infractions faisant l'objet de poursuites par voie de mise en accusation : Le terme «inculpé» (qui s'entendait à l'origine d'une personne considérée comme coupable d'une faute) aurait une vocation générique et s'emploierait pour désigner toute personne à qui une telle infraction est imputée. On établirait par ailleurs une distinction entre «prévenu» et «accusé». La personne poursuivie par voie de mise en accusation s'appellerait prévenu au cours des étapes préalables au procès (par exemple : l'enquête préliminaire) et deviendrait l'accusé à partir du moment où un acte d'accusation («indictment») serait présenté contre elle, le cas échéant.
