La Cour d'appel fédérale dans l'affaire Forum des maires, établit quant à elle, une distinction entre, d'une part, les articles 42 et 43 de la Loi sur les langues officielles (LLO), qui imposeraient certaines obligations à Patrimoine canadien et, d'autre part, l'article 41 de la Loi sur les langues officielles (LLO) qui ne contiendrait qu'un simple engagement et confirme, comme dans l'affaire Raîche, que cette disposition est de portée déclaratoire.
