That portion of a major highway on settlement land which, as a result of reconstruction and realignment of a major highway occurring prior to the effective date of this agreement, ceases to be used as part of the major highway in fact, notwithstanding it remains a portion of a "highway" within the meaning of the Highways Act, S.Y. 1991, c. 7 until closed.
