The American cases, which are much more numerous than the Canadian and Commonwealth ones, have drawn a line between mere insult, which is not actionable, and "extreme and outrageous" conduct, which is. The latter type of conduct is not only more reprehensible, and therefore more deserving of sanction, but there is also a greater likelihood that the mental suffering is not feigned in such a case.

La jurisprudence américaine, beaucoup plus abondante dans ce domaine que la jurisprudence du Canada et du reste du Commonwealth, fait une distinction entre une simple insulte, qui ne donne pas ouverture à une poursuite, et une conduite "extrême et outrageante", qui confère, elle, un droit d'action. Non seulement ce dernier type de conduite est-il plus répréhensible, et mérite-t-il par conséquent davantage d'être sanctionné, mais il est aussi plus probable que les souffrances morales ne sont pas feintes.
