La principale difficulté reliée à une définition de l'actus reus découle du fait que l'élément matériel varie dépendant de l'infraction. Dans le cas d'un homicide, c'est le résultat qui est incriminé eu égard au mode d'exécution utilisé. La mort pourrait être le résultat d'un empoisonnement, d'une strangulation ou d'un coup de feu.
