La common law, contrairement au droit français, ne fait pas la distinction entre le pourvoi et l'appel et ne reconnaît pas le principe du double degré de juridiction. Dans le cas du pourvoi devant la Cour (française) de Cassation, ce tribunal ne représente pas un troisième degré de juridiction, car lorsqu'il casse une décision, il renvoie la connaissance de l'affaire à une juridiction du même degré que celle dont la décision est cassée.
