For a time, however, the courts awarded damages for nervous shock only where there was also some physical injury inflicted or at least where there was an "impact". In other words, recovery was parasitic. Damages were awarded for mental suffering when someone was thrown against a seat in a streetcar, and when someone's throat was scratched by some broken glass found in bread.

Il fut toutefois un temps où les tribunaux n'accordaient de dommages-intérêts pour choc nerveux que s'il y avait eu également un dommage corporel ou, tout au moins, un "impact'. En d'autres termes, le recours était subordonné. Ainsi, la personne qui avait été projetée contre le siège d'un tramway de même que celle qui avait eu la gorge écorchée par un morceau de verre dans son pain ont pu obtenir réparation pour le préjudice psychologique subi.
