The inability to consummate the marriage may arise from a physical incapacity or from an invincible repugnance or aversion to sexual intercourse. The sexual incapacity may be general in character or it may exist only as between the spouses themselves.

Pour qu’un mariage soit considéré comme valide, il faut encore que les parties aient la capacité physique de le consommer. Les tribunaux de common law ont établi que l’incapacité de consommer le mariage signifie être incapable de rapports sexuels ordinaires complets, à la condition que l’autre partie n’aie pas été au courant des difficultés de son futur conjoint.
