Règlement des différends : Les différends qui pourraient survenir entre les investisseurs et l'État étranger peuvent être soumis à l'arbitrage. L'investisseur et l'État doivent tenter de régler le différend dans le cadre de consultations pré-arbitrage; en cas d'échec, l'investisseur pourra demander que le différend soit tranché par voie d'arbitrage indépendant. L'arbitrage sera conforme aux règles du Centre international pour le règlement des différends relatifs aux investissements (CIRDI) ou de la Commission des Nations Unies pour le droit commercial international (CNUDCI).
