The duty of informed consent requires, among other things, that all material risks be disclosed to a patient. A material risk is something a "reasonable person" in the patient's position would want to know in order to make an informed decision about treatment.

Par risques importants, on entend les risques significatifs qui présentent un réel danger pour la vie, la santé ou le bien-être du patient. Pour déterminer s'il existe un risque important, il faut évaluer la gravité des résultats éventuels, ainsi que leur probabilité. Même s'il n'y a que de faibles chances de traumatisme grave ou de décès, on pourra considérer qu'il s'agit d'un risque important; on pourra par ailleurs en venir à la même conclusion s'il existe des risques élevés d'un préjudice sans gravité.
