Sur le plan légal, il faut mentionner qu'un juge de paix ou un magistrat, exerçant une juridiction personnelle, conserve ses pouvoirs de common law, à moins de dérogations statutaires. La jurisprudence contient assez peu de cas où on s'est appuyé sur cette disposition, mais il faut souligner le droit de tout juge de paix d'exiger qu'une personne remette un engagement de garder la paix.
