The mission of the Public Curator is to protect the civil and property rights of persons declared unfit under law. The Public Curator represents people of legal age incapable of ensuring their moral and physical well-being, and also protects their rights. In addition, the Public Curator monitors, informs and assists private guardians and curators in their work as well as administers vacant successions and abandoned assets. The Public Curator also has the power to conduct inquiries in the event of complaints about how those mandated to care for incapacitated persons are performing their duties.

La mission première du curateur public concerne la protection et la représentation des personnes inaptes par des moyens adaptés à leur milieu de vie respectif. Le curateur public représente directement les personnes sous régime de protection public et joue un rôle de surveillance auprès des représentants légaux des personnes sous régime de protection privé. L'administration des biens des personnes inaptes est un corollaire à cette mission dans la mesure où elle contribue au bien-être de la personne. Le curateur public assume, en plus, la gestion publique des biens non réclamés.

An individual appointed by the government to oversee trust situations for persons lacking legal capacity to do so on their own.

CONT

When a person dies whether testate or intestate and his real or personal property or both have not been taken possession of by his executors or next of kin, the Public Trustee (a) may take possession of the property forthwith, and (b) may safely keep, preserve and protect the property.

OBS

The appellation "public trustee" is used in all common law provinces in Canada except in New Brunswick and in Prince Edward Island where its counterparts are respectively "public administrator" and "official trustee". In Quebec the English equivalent of "curateur public" is "public curator".

OBS

Les «public trustee», «public administrator» et «official trustee» dans les provinces de common law du Canada ont les mêmes attributions et remplissent les mêmes fonctions en matière de successions et sont les homologues du «curateur public» au Québec. «Curateur public» est employé en Ontario pour traduire «public trustee» et «administrateur public» au Nouveau-Brunswick pour traduire «public administrator». On peut aussi l'employer pour traduire «official trustee». Il faut tenir compte de ces différentes appellations anglaises lorsqu'on retraduit «curateur public» vers l'anglais.
