An individual appointed by the government to oversee trust situations for persons lacking legal capacity to do so on their own.

CONT

When a person dies whether testate or intestate and his real or personal property or both have not been taken possession of by his executors or next of kin, the Public Trustee (a) may take possession of the property forthwith, and (b) may safely keep, preserve and protect the property.

OBS

The appellation "public trustee" is used in all common law provinces in Canada except in New Brunswick and in Prince Edward Island where its counterparts are respectively "public administrator" and "official trustee". In Quebec the English equivalent of "curateur public" is "public curator".

Les «public trustee», «public administrator» et «official trustee» dans les provinces de common law du Canada ont les mêmes attributions et remplissent les mêmes fonctions en matière de successions et sont les homologues du «curateur public» au Québec. «Curateur public» est employé en Ontario pour traduire «public trustee» et «administrateur public» au Nouveau-Brunswick pour traduire «public administrator». On peut aussi l'employer pour traduire «official trustee». Il faut tenir compte de ces différentes appellations anglaises lorsqu'on retraduit «curateur public» vers l'anglais.
