El principio conocido como "par condito creditorum" que en las situaciones de insolvencia pretende distribuir el patrimonio del deudor entre todos sus acreedores en pie de igualdad, quiebra en aquellos créditos en que por razones no sólo jurídicas, sino de política social o económica la Ley le atribuye un trato preferencial. Son los llamados créditos privilegiados. Estos privilegios consisten bien en que pueden ser reintegrados separadamente de los demás y/o sobre determinados créditos (separatio ex iure crediti), bien en que han de ser pagados antes que otros.
