4. The word tort comes from le Latin term torquere, which means "twisted or wrong." The English common law recognized no separate legal action in tort. Instead, the British legal system afforded litigants two central avenues of redress: trespass for direct injuries, and actions "on the case" for indirect injuries. Gradually, the common law recognized other civil actions, including defamation, libel, and slander. 2, record 11, English, - action%20in%20tort

The field of occupier's liability has been complicated further by an overridding distinction between an "activity duty" and an "occupancy duty", which derives from the misfeasance-nonfeasance dichotomy. If an entrant is injured by "current operations" being carried out by the occupier on the land, as opposed to a defect or danger in the condition of the land, the courts will impose the general duty to use reasonable care. This general duty is owed to all persons lawfully on the premises, but it is unclear whether it is also applicable to trespassers whose presence is known or probable. 1, record 26, English, - activity%20duty
