On distingue […] trois cas de «capitis deminutio» qui entraînent un changement de statut («status permutatio»): la «maxima» quand l’homme libre devient esclave; la «media» quand, tout en gardant la liberté, un individu change de citoyenneté; la «minima» quand un individu passe d’une «familia» dans une autre.

OBS

L'expression «capitis deminutio minima» se traduit littéralement par «petite diminution de tête» dans le contexte du droit romain. Elle se dit lorsqu'un citoyen romain changeait l'état de famille sans perdre le droit de cité. De ce fait, nous suggérons l'équivalent «perte minimale de personnalité civile» au lieu de «petite diminution de tête».
