The Supreme Court of Canada is the court of last resort (or the highest court) in Canada. As the final general court of appeal it is the last judicial resort of all litigants. Its jurisdiction embraces both the civil law of the province of Quebec and the common law of the other nine provinces and three territories. La Cour suprême du Canada est le tribunal de dernier ressort (ou plus haute cour) du Canada. En tant que cour générale d'appel de dernière instance, elle constitue le dernier recours judiciaire de toutes les parties. Elle a compétence tant à l'égard des affaires touchant le droit civil du Québec qu'à l'égard des affaires touchant la common law applicable dans les neuf autres provinces et trois territoires. The Supreme Court of the United States, located in Washington, D.C., is the highest court (see Supreme Court) in the United States; that is, it has ultimate judicial authority within the United States to interpret and decide questions of federal law. It is head of the judicial branch of the United States Government. The other two branches of the United States Government are the executive branch and the legislative branch. C'est ici que l'instance judiciaire joue un grand rôle. Les Américains perçoivent les tribunaux comme les gardiens ultimes de leurs droits et de leurs libertés. La constitution préserve d'ailleurs l'indépendance du pouvoir judiciaire en prévoyant la nomination à vie des juges de la Cour suprême (Supreme Court). La sélection des juges de ce tribunal par le président est donc extrêmement importante. Elle fait l'objet d'une approbation par le Sénat, qui peut interroger le candidat et rejeter sa nomination.
