Il appartient aux juges du fond de déterminer souverainement le sens véritable des intentions du testateur, sans être liés par les termes mêmes employés (...) Dans la recherche des intentions du testateur, les juges doivent s'inspirer avant tout des termes mêmes du testament. Mais si ces termes ne sont pas suffisamment clairs, la jurisprudence admet qu'on peut recourir à des circonstances extrinsèques pour interpréter le testament et se fonder tant sur d'autres écrits émanant du testateur que sur les circonstances de la cause.
