Pour qu'une absence sans permission prenne fin, il ne suffit pas que la personne absente se présente à l'autorité civile ou militaire, pas plus qu'il ne suffit d'ordonner à cette personne de rejoindre son unité. Toutefois, si lorsqu'elle reprend son service, la personne absente est mise sous garde ou est traitée en vertu des ordres, de la pratique ou des usages militaires comme ayant cessé d'être absente, on considère que son absence a pris fin.
