Cependant, elle ne doit pas être exclue, notamment parce que rien n'empêche de choisir un médiateur qui est un technicien, ou d'imaginer une formule empruntant à l'expertise et à la médiation. On constate souvent que le résultat de l'expertise sert de base de négociation aux parties.
