... a federal state sometimes ratifies a treaty by taking advantage of a "federal state" clause, which represents a type of "fractional" ratification, i.e., a ratification which requires only the federal government and not the members of the union to take action under the treaty.

Pour pallier aux difficultés suscitées par la conclusion des traités dans les fédérations, quelques conventions comportent, on le sait, une clause dite «fédérale». Cette dernière favorise la participation des fédérations à certains traités multilatéraux dont le sujet relève en tout ou en partie de la compétence constitutionnelle des membres de la fédération; en vertu de cette clause, il n'est pas essentiel d'attendre pour la conclusion d'un traité que tous les membres de la fédération soient en mesure d'appliquer les dispositions du traité qui les concernent.
