By Statute 4 George VI, c. 21, assented to July 12, 1940, an Associate Minister of National Defence, a Minister of National Defence for Naval Services and a Minister of National Defence for Air could be appointed on the issuance by the Sovereign or the Governor in Council, pursuant to the War Measures Act, of a proclamation declaring the existence of war, invasion or insurrection, real or apprehended. Appointments to these three offices could be made until six months after the issuance of a further proclamation declaring that the war, invasion or insurrection no longer existed.

La Loi 4 George VI, c. 21, sanctionnée le 12 juillet 1940, permettait alors de nommer, en vertu de la Loi sur les mesures de guerre, un ministre associé de la Défense nationale, un ministre de la Défense nationale pour le service naval et un ministre de la Défense nationale pour l'air sur délivrance par le souverain ou le gouverneur en conseil d'une proclamation reconnaissant l'état de guerre, d'invasion ou d'insurrection, réelle ou prévue. Les nominations à ces trois postes pouvaient se faire jusqu'à six mois après la proclamation de la fin de la guerre, de l'invasion ou de l'insurrection.
