Under the present law if the accused takes the stand in his own defence he can be questioned about any previous convictions. Since such evidence si very prejudicial, many accused persons understandably choose not to take the stand. Under those circumstances, comment by the judge or prosecution about the accused's not taking the stand would be unfair. Generally, section 64(2) would permit the accused to take the stand without fear that his previous convictions would become known to the trier of fact.

Le droit actuel permet d'interroger au sujet de son casier judiciaire le prévenu qui rend témoignage au cours de sa défense. En raison du tort que cette preuve risque de leur occasionner, nombre d'accusés préfèrent ne pas témoigner, ce qui se comprend sans peine. Il serait injuste dans ce cas, de permettre au juge ou à la poursuite de commenter leur abstention de rendre témoignage. Or, l'article 64(2) du présent Code reconnaît au prévenu le droit de déposer au cours de sa défense, sans avoir à craindre que l'arbitre des faits ne soit mis au courant de ses condamantions antérieures.
