The situation might have been assessed incorrectly, and/or there could have been a lack of knowledge of the situation. In a mistake, the original intention is inadequate; a failure of planning is involved.

There are three situations in which mistake may arise [when making a will]: 1. The wrong document may be executed; 2. There may be mistake going to the motive for a provision in a will; 3. There may be mistake as to the effect of a will, or of one or more of its provisions.

In addition to proving mental capacity, those who propound a will for probate must also prove that the testator knew and approved of the contents of the will and probate will be refused the will (or part thereof), without any trace of mental infirmity, if there is evidence of undue influence exerted by another, or if it is shown that the testator was misled by some mistake, whether the mistake was induced by fraud or, simply by accident.

Dans le cas des libéralités, c'est donc une erreur sans laquelle le disposant n'aurait pas donné ou testé, ou au moins n'aurait pas donné ou testé en faveur du même bénéficiaire.
