Il n'est pas si facile de distinguer entre le dommage passé et le dommage futur. Dans le premier, il est certain puisqu'il a déjà été prouvé. Dans le second cas les effets du dommage (qui existe) se produiront probablement, dans l'avenir. Au fond, le dommage est toujours présent: c'est l'évaluation du dommage qui doit prendre en considération le caractère de l'effet préjudiciable dans le futur, au regard du degré de probabilité exigé.
