Asimismo, el artículo 5º aclara que la determinación de la condición de emergencia médica será realizada por el profesional médico encargado de la atención, bajo su responsabilidad. Para ello, todo personal que brinda atención de emergencia en un establecimiento de salud, debe tener capacitación suficiente para el manejo de este tipo de pacientes, tal como lo complementa el artículo 6º.
