A right of use over the property of another.

OBS

The easement is normally for the benefit of adjoining lands rather than for the benefit of a specific individual. The land having the right of use is known as the dominant property, and the land which is subject to the easement is known as the servient property. The easement grants the owner of the dominant property an interest in the land for the right to use the servient property for a specific purpose.

Une servitude profite habituellement aux propriétaires de biens-fonds contigus plutôt qu’à une personne en particulier. Le propriétaire du fonds dominant est celui qui bénéficie du droit d’utilisation alors que le propriétaire du fonds servant en a la charge. La servitude confère au propriétaire du fonds dominant le droit d’utiliser le fonds servant à une fin précise.

An easement is a privilege without profit annexed to land to utilize the land of a different owner (which does not involve the removal of any part of soil or the natural produce of the land) or to prevent the other owner from utilizing his land in a particular manner for the advantage of the dominant owner. It has been described as a right annexed to land which permits the owner of the dominant tenement to require the owner of the servient tenement "to suffer or not to do" something on such land. (Anger and Honsberger, 2nd ed., 1985, p. 925).

A charge or burden resting upon one estate for the benefit or advantage of another; a species of incorporeal right derived from the civil law [and] closely corresponding to the "easement" of the common-law, except that "servitude" rather has relation to the burden or the estate burdened, while "easement" refers to the benefit or advantage or the estate to which it accrues.

International regimes are sometimes compared to so-called servitudes, which is a term used in international law on an analogy with Roman law to mean a charge on premises in favour of the owner of another piece of land. In international law the term refers to permanent restriction on the jurisdiction over a piece of territory in favour of rights conceded to another State. Examples can be seen in the difference between the frontiers which are drawn for political and for customs purposes in various parts of the world.
