Règle d'interprétation voulant que les tribunaux ne puissent se saisir eux-mêmes de problèmes constitutionnels, qu'ils doivent refuser de se prononcer sur des questions constitutionnelles devenues théoriques, qu'ils ne doivent pas se prononcer sur une question constitutionnelle même valablement soulevée si le litige peut être réglé sur une autre base et, enfin, qu'ils ne se prononcent sur la constitutionnalité d'une norme juridique que dans la mesure nécessaire pour solutionner le conflit ou pour répondre à la question.
