The field of occupier's liability has been complicated further by an overridding distinction between an "activity duty" and an "occupancy duty", which derives from the misfeasance-nonfeasance dichotomy. If an entrant is injured by "current operations" being carried out by the occupier on the land, as opposed to a defect or danger in the condition of the land, the courts will impose the general duty to use reasonable care. This general duty is owed to all persons lawfully on the premises, but it is unclear whether it is also applicable to trespassers whose presence is known or probable.

Une complication supplémentaire est venue s'ajouter au droit de la responsabilité des occupants, les tribunaux ayant fait une distinction entre le «devoir relié à l'activité» et le «devoir relié à l'occupation», qui découle de la dichotomie action/inaction fautives. Si une personne subit des blessures à cause des «activités» poursuivies par l'occupant sur les lieux, plutôt que d'une défectuosité ou d'un danger résultant de la condition des lieux, les tribunaux exigeront du défendeur qu'il fasse preuve d'une prudence raisonnable, le devoir général. L'occupant a un tel devoir envers toutes les personnes qui se trouvent légitimement sur les lieux, mais il n'est pas certain qu'il ait la même obligation envers les trespassers dont la présence est connue ou probable.
