In construing a will, the aim of the Court of construction should be to determine the precise disposition of the property intended by the testator. The Court should attempt to ascertain, if possible, the testator's actual or subjective intent as opposed to an objective intent presumed by law. The Court should not be concerned with a hypothetical or reasonableman standard, but with the meaning that the particular testator attached to the words used in his will. 2, record 1, English, - court%20of%20construction

Il ne faut pas perdre de vue (...) que la Court of Probate n'est point une Cour d'interprétation. Le sceau de la Court of Probate est bien en soi la preuve de la confection d'un testament, mais là se bornent les pouvoirs de cette Cour. Mais une Cour d'Équité considère un exécuteur ou un administrateur cum testamento annexo comme un «trustee», et c'est donc elle qui normalement doit interpréter le testament pour savoir si l'exécuteur ou l'administrateur s'est conformé aux prescriptions concernant le «trust». Aussi appelle-t-on généralement les Cours d'Équité «Cour d'interprétation» pour bien marquer l'opposition qui existe avec la Court of Probate. 1, record 1, French, - cour%20d%27interpr%C3%A9tation
