An implied licence arises where a patented article is sold without restriction. Such sale gives to the purchaser an implied licence to deal with the purchased article in any manner he sees fit. He may make simple repairs but not such repairs as amount to a remaking of the article, and he may also sell or use the purchased article in any country in which the vendor owns a patent.
