En ella también va involucrada no solamente la voluntad y el deseo de efectuar el contrato, sino también no estar sometido a coerción alguna. El consentimiento sigue un proceso y está ligado a la forma de presentación del problema por parte del médico al paciente, que debe involucrar precisiones sobre ventajas o desventajas, costos y beneficios, que permitirá generar en el paciente el acuerdo sobre la base de una información útil y realista. Este consentimiento será válido si se cumplen requisitos tales como información adecuada y completa, en el sentido del esclarecimiento del problema y en el sentido de la oportunidad del informe.
