  • The need for a third standard of review is especially clear in cases, like this one, in which appeal from a tribunal’s decision lies by statutory right. The presence of the statutory right of appeal obviates the need to find a jurisdictional error.
  • La nécessité d’avoir recours à une troisième norme est particulièrement évidente dans les cas où, comme en l’espèce, le droit d’interjeter appel de la décision du tribunal administratif est prévu par un texte de loi. L’existence d’un tel droit fait qu’il n’est pas nécessaire de chercher des erreurs de nature juridictionnelle.
