Obs. : Il importe d’établir une distinction entre un droit substantiel / un droit matériel, qui correspond à substantive right, et le droit positif, qui correspond à substantive law.

Un droit substantiel (ou matériel) est un droit (right) qui touche le fond du droit et qu’un justiciable peut faire valoir en justice. On dit aussi : droit matériel découlant du droit positif ou encore règles de fond ou règles matérielles.

Le droit positif est un ensemble de règles de droit (law) en vigueur sur un territoire déterminé. Il s’oppose au droit procédural (adjective law / procedural law).
