Under the old law, a deed could not be delivered, as an escrow, direct to the grantee. Delivery in escrow was made to a third party-the first delivery-and, upon the fulfilment of the condition, the third party would deliver the deed to the grantee-the second delivery. It seems that the old law no longer applies. There are two sorts of delivery and two only, known to the law, one absolute and the other conditional, that is an escrow to be the deed of the party when, and if, certain conditions are performed. ... when cryptography is used for data communications, key delivery can be awkward, because each and every key must be somehow delivered to the far end(and retained) in absolute secrecy. On the other hand, this requirement also assures that each end gets exactly the same key, something which simple "public key" systems rarely guarantee.
