Escheat therefore being a title frequently vested in the lord by inheritance, as being the fruit of a signiory to which he was entitled by descent, it may seem in such cases to fall more properly under the head of acquiring title to estates, viz, by descent, by purchase. The thing required may be the correction of a title defect, the production of a draft document, a survey, mortgage statement, Land Division Committee consent or any other thing to which the party to the transaction is entitled. The English "Wills Act" of 1837 permitted "any soldier being in actual military service or any mariner or seaman being at sea" to make an informal will of his personal property and the provision was written into the earliest Wills Acts in Canada and is still to be found in all provinces except Quebec, including those provinces which do not allow holograph wills.
