Maximum sum of money payable by a carrier to a shipper or bill of lading holder for any damage or loss to the cargo for which the carrier is liable under the contract of carriage. The basis of the limitation may be per piece of package or per tonne or per container according to the particular contract. The amount of the limitation is determined by agreement of the two parties or by law.

The general rule is that where damage is suffered by any person as a result of a tort, any tortfeasor liable in respect of that damage may recover contribution from any other tortfeasor who is, or would if sued have been, liable in respect of the same damage, whether as joint tortfeasor or otherwise. There must, first of all be a common liability in tort. This precludes contribution between one liable in contract and another in tort.

In France, judicial proceedings taken by a government department against an employee who has committed a fault for which the department has been found liable by a court of law.

OBS

In England such an action would be founded on tort and described as an action for contribution or indemnity. The French term "action de recours" would seem to include actions of this kind which are founded on contract as well e. g. an "action en garantie", action to enforce a warranty, where it concerns peaceful possession, and an "action cambiaire", action on a negotiable instrument, where it is taken against a liable on the instrument who is not the person dishonouring it.

It is a rule in actions ex contractu that all who have a legal interest in the contract and no others, must join in action founded on a breach of such contract; whether the parties are too many or too few, it is equally fatal. In actions ex contractu all obligors jointly and not severally liable and no others, must be made defendants.

It might have been thought that in a sale of specific goods there would be an implied condition on the part of the seller that the goods were in existence at the time when the contract was made. Since the seller warrants, as we shall see shortly, that he has a right to sell the goods, and since he is in many cases responsible for defects in the quality of the goods, it might seem that a fortiori he should be liable if he has sold non-existent goods.
