A rent charge arises when a periodic sum of money is payable in respect of land to a person who has no reversion in it, the due payment of which is a charge upon the land and is secured by a right of distress given by express agreement between the parties. A rent charge in fee simple is an incorporeal hereditament and is real property as it is an interest in the land itself. By arrangement between creditor and debtor property is transferred by the debtor to a trustee... which holds the property on trust terms for the creditor. The terms of the trust, agreed between debtor and creditor, will set out what advantages are to be taken by the beneficiary during the lifetime of the trust, under what circumstances the trust will be terminated or come to a close, and to whom the trust property shall then be payable. The first table of the value of a life annuity of which we have any record, called the Ulpian Table(devised by a great Roman jurist, Ulpianus), arose out of the Falcidian Law. This law, enacted in B. C. 40, prevented a testator leaving more than three-quarters of his property to others than his legal heirs.
