In general, recording statutes are classified as race statutes, notice statutes and race-notice statutes. Under a race statute, the first person to register his interest gains priority and notice is unimportant. Under a notice statute, notice is all-important and a subsequent taker obtains priority over an unregistered prior interest if, when his interest is acquired, he is without notice. He need not register so long as he is without notice when his interest is acquired. The race-notice statute requires the subsequent taker to be without notice(presumably when the interest is acquired) and to record his interest before the prior holder records. In general terms, the "Registry Act" in Ontario, and the Torrens system of registration are race-notice and race statutes, respectively, although judicial interpretation has blurred this basic distinction.(Anger and Honsberger, 2nd ed., 1985, p. 1594).

An owner of land may voluntarily apply to the Director of Titles to have the title to any land in Ontario under the registry system investigated and certified.(Donahue and Quinn, 3rd ed., 1982, p. 15).

A supplier who, pursuant to subsection II(1) of the Hazardous Materials Information Review Act, files a claim for exemption from a requirement to disclose information in respect of a controlled product on a material safety data sheet or on a label shall, in respect of the sale or importation of the controlled product or any controlled product having the same product identifier, disclose on the material safety data sheet and, where applicable, on the label of the controlled product or container in which the controlled product is packaged the date that the claim for exemption was filed and the registry number assigned to the claim under the Hazardous Materials Information Review Act. The Hazardous Materials Information Review Commission decides whether a claim for exemption is valid, and whether the proposed label and MSDS for the controlled product meet WHMIS requirements. The Commission is a federal agency reporting to the Minister of Consumer and Corporate Affairs Canada.
