The field of occupier's liability has been complicated further by an overridding distinction between an "activity duty" and an "occupancy duty", which derives from the misfeasance-nonfeasance dichotomy. If an entrant is injured by "current operations" being carried out by the occupier on the land, as opposed to a defect or danger in the condition of the land, the courts will impose the general duty to use reasonable care. Si une personne subit des blessures à cause des «activités» poursuivies par l'occupant sur les lieux, plutôt que d'une défectuosité ou d'un danger résultant de la condition des lieux, les tribunaux exigeront du défendeur qu'il fasse preuve d'une prudence raisonnable, le devoir général.
