One of the parties to a contract may, before the time fixed for performance, say that he will not perform, or incapacitate himself from performing. Such conduct is sometimes called "anticipatory breach". The other party then has a choice. He can try to keep the contract alive by continuing to press for performance, in which case the anticipatory breach will have the same effects as an actual breach. The operation of the St. Andrews dam, constructed downstream by the federal government between 1903 and 1910 resulted in the gradual erosion of the river bank and forced the plaintiff in 1986, to abandon her home and to construct a new one farther away from the river. The plaintiff in this action, initially representative in nature, claimed damages for past injury.
