On 6 July 1990, the Heads of State or government of the Member States of the North Atlantic Treaty Organisation(NATO) issue the London Declaration on a Transformed North Atlantic Alliance. In International Law.... The right of a belligerent to visit and search neutral merchant vessels. It is exercised, first, as an incident to the belligerent right to capture, upon the high seas, private property of enemy subjects.... Secondly,... as an incident to the recognized belligerent right to prevent the carriage of contraband... by neutral vessels to the enemy, and to punish breaches of blockade. L'expression française "droit de visite" comprend deux opérations: d'abord, la vérification du droit du navire au pavillon qu'il arbore, ensuite, l'inspection du navire et de sa cargaison, cette dernière étant une sorte de perquisition avec cette importante différence que le terme péjoratif "perquisition" est inusité dans les relations maritimes internationales. Par diplomatie, les conventions internationales lui substituent "visite", car c'est souvent une formalité qui exonère le navire visité de tout soupçon de contrebande ou d'activités hostiles à l'Etat qui exerce son "droit de visite". Les auteurs anglo-américains distinguent nettement les deux opérations dans les expressions "right of visit" ne comportant que la vérification des papiers du bord, et "right of search" qui est le droit de visiter le navire pour y rechercher de la contrebande et des passagers ennemis. A diplomatic instrument, signed on Feb. 26, 1909, which contained the terms for an international law of naval warfare. To codify the principles of international maritime law in regard to prize cases(prize courts pass on the legality of capture at sea during wartime), experts from Austria-Hungary, Britain, France, Germany, Italy, Japan, the Netherlands, Russia, Spain, and the United States met in London in 1908. The transfer of an enemy vessel to a neutral flag, effected before the outbreak of hostilities, is valid, unless it is proved that such transfer was made in order to evade the consequences to which an enemy vessel, as such, is exposed. There is, however, a presumption, of the bill of sale is not on board a vessel which has lots her belligerent nationality less than sixty days before the outbreak of hostilities, that the transfer is void. This presumption may be rebutted. Liability to capture. It was Lord Stowell who introduced in prize law the rule that forfeiture of the neutral vessel can only follow upon proof of knowledge by the shipowner of the contraband nature of the cargo. The true test of liability to capture was, in Lord Stowell' s view, the state of mind of the neutral claimant :... The Declaration of London elected to rest the principle of confiscation not on the knowledge of the owner, but on the relative proportion of contraband to the whole cargo.
