Il s’agit d’une ancienne règle de common law qui dérive essentiellement du droit de la Couronne et qui porte que le «titulaire d’une charge selon bon plaisir» est à la merci de son employeur. Il s’agit d’un anachronisme puisqu'aujourd’hui les conventions collectives protègent de la destitution arbitraire les employés qui ne peuvent invoquer le statut de titulaires de charge. De nos jours, le droit à l'équité procédurale est accordé aux titulaires d’une charge «selon bon plaisir». La documentation révèle que la terminologie a évolué et que maintenant on distingue la nomination à titre amovible(«during pleasure») de la nomination à titre inamovible(«during good behaviour»).
