L'usage est en principe d'utiliser «par» pour un renvoi à la Loi dans son ensemble et «à» pour un renvoi fait à une partie seulement mais la distinction semble un peu artificielle et n'est pas appliquée uniformément. Par exemple, c'est «à» qui normalement convient à un code, ce qui fait dire «les conditions fixées au code», mais «les conditions fixées par la loi».
