Dans le cas de changements se rapportant à la situation personnelle d'un demandeur d'asile qui fonde sa demande d'asile sur celle-ci, la Section de première instance a statué (dans le contexte d'une demande relative à la perte de l'asile) que le ministre n'a pas le fardeau de démontrer que l'agent de persécution a changé et que le changement est durable. Il suffit que la Commission [Commission de l'immigration et du statut de réfugié] soit convaincue que le changement de circonstances est important et efficace.
