Le droit de disposer (abusus). Le droit de disposer du bien est une prérogative fort étendue. Il n'est sans doute pas exagéré de la qualifier de faculté résiduaire, tant on lui prête vocation à recueillir les services difficilement conciliables avec les autres attributs de la propriété. C'est en vertu de cet attribut que le propriétaire peut poser des gestes qui portent sur la matérialité du bien en agrandissant, par exemple, un bâtiment existant ou même en le détruisant.
